A Southern California family outing ended in heartbreak when a father died while rescuing his 7-year-old son from a potential drowning at Lake Perris. According to state park officials, the fatal incident occurred after the family's kayak capsized on a windy Sunday afternoon.
Authorities say the father, identified as 40-year-old Victor Torres of Bellflower, was out on the lake with his wife and young son when strong winds caused their kayak to flip. All three were thrown into the water without life jackets, triggering a desperate scramble to stay afloat.
While the boy's mother was able to reach safety, Torres prioritized getting his son to shore. After successfully helping his son out of the water, Torres became submerged and did not resurface. Rescue divers recovered his body later that day.
Officials emphasized that no one in the kayak was wearing a life jacket, a crucial safety failure that likely contributed to the fatal outcome. Lake Perris, like many reservoirs in California, is subject to sudden changes in wind and water conditions that can quickly turn dangerous — especially for boaters and paddlers.
Michael Haggard, Esq., an attorney with The Haggard Law Firm who specializes in drowning cases, commented on the tragic event. “This father’s heroic act shows the love and instinct to protect, but also highlights the importance of water safety — especially wearing life jackets. Far too often, drownings occur not from negligence, but from underestimating nature’s power and overestimating swimming ability.”
Though the event appears accidental, questions may arise regarding safety protocols, signage, and whether proper warnings were posted or communicated. If the lake or kayak rental services failed to provide clear safety instructions or adequate life jackets, there may be grounds for a civil claim.
Haggard adds, “If public or private entities managing recreational sites fail to enforce or encourage basic safety measures — like requiring life jackets or posting wind advisories — they could be liable when a tragedy occurs.”
The emotional toll on surviving loved ones after a drowning death is immeasurable. However, pursuing a legal claim can help cover funeral costs, loss of financial support, and emotional suffering. It can also help ensure public recreation areas improve safety policies to prevent further loss of life.
